1. Purpose of these Terms

These Terms of Use (hereinafter the "Terms") set out the conditions under which OdysseAI makes available its AI-assisted travel planning service (the "Service"), and the rights and obligations of the user (the "User"). Commercial conditions (subscriptions, billing, right of withdrawal) are described in the Terms of Sale. Definitions: • Service: the OdysseAI web application allowing you to browse itinerary templates, create and plan trips, and generate itineraries using artificial intelligence. • User: any natural person using the Service, whether or not they hold an account. • Account: personal space created by the User giving access to the personalised features of the Service. • Template: a pre-designed itinerary publicly shared on the Service. • Trip: an itinerary created or saved by the User in their Account.

2. Acceptance and amendment

Using the Service implies full and unreserved acceptance of these Terms. The User acknowledges having read and accepted them by ticking the relevant box when creating their Account. OdysseAI reserves the right to amend the Terms at any time. In the event of a material change, the User will be notified via an in-app notification. Continued use of the Service after notification constitutes acceptance of the amended Terms.

3. Access to the Service and eligibility

The Service is accessible through any modern web browser with an Internet connection. Certain features require the creation of an Account. The User must be at least 16 years old to create an Account. Users under 16 must obtain prior authorisation from their legal guardians. OdysseAI strives to keep the Service available 24/7 but does not guarantee uninterrupted availability. Interruptions may occur for maintenance, updates, or for reasons outside OdysseAI's control (third-party outages, force majeure).

4. Account creation and security

Creating an Account requires the following information: first and last name, a unique username, an email address, and a password (or the use of Google Sign-In). The User agrees to provide accurate information and to keep it up to date. The username must be unique on the Service. The User is solely responsible for the confidentiality of their credentials and for all activity conducted from their Account. In the event of suspected unauthorised access, the User must notify OdysseAI without delay at plan.odysseai@gmail.com. A User may only hold a single Account. Creating multiple accounts is prohibited.

5. AI-generated content

Itineraries and suggestions generated by the Service rely on artificial-intelligence models provided by Google (Gemini). AI-generated content is provided for informational purposes only. The User acknowledges that: • AI may produce inaccurate, outdated or incomplete information (errors on prices, opening hours, addresses, availability). • It is the User's responsibility to independently verify all critical information before making travel decisions, including: visa requirements, entry conditions for a country, opening hours, availability, actual prices, health or sanitary constraints. • OdysseAI does not guarantee the accuracy, completeness or timeliness of AI-generated content. • OdysseAI is not liable for the consequences of decisions made on the basis of AI-generated content.

6. User-generated content

The User may publish content on the Service, including reviews and personal itineraries. The User retains ownership of their content. By publishing a public review, the User grants OdysseAI a non-exclusive, worldwide, royalty-free licence to display, reproduce and distribute that review within the Service for as long as the Account exists. The User agrees not to publish content that is: • illegal, defamatory, insulting, threatening, hateful, discriminatory or pornographic • infringing intellectual-property or privacy rights of third parties • spam, unsolicited advertising or manipulation of the Service OdysseAI reserves the right to moderate, remove or reject any non-compliant content, and to suspend or terminate the User's Account in the event of breach.

7. Acceptable use

The User agrees to use the Service in accordance with its intended purpose and with these Terms. The following are prohibited in particular: • Automated data extraction (scraping), use of bots or unauthorised scripts. • Automated calls to AI generations aimed at circumventing quotas or overloading the Service. • Attempts to bypass technical limitations or security mechanisms. • Reselling, sharing or providing Accounts to third parties. • Any use likely to harm the operation of the Service or other users. In the event of breach, OdysseAI reserves the right to suspend or terminate the Account, without prejudice to any legal action.

8. Intellectual property and affiliate links

The OdysseAI brand, domain name, logo, interface, pre-designed templates and all elements making up the Service are the exclusive property of OdysseAI (or its licensors). Any reproduction, representation or exploitation without prior written authorisation is prohibited. OdysseAI grants the User a personal, non-exclusive and non-transferable licence to use the Service for their private needs. Affiliate links: the Service contains links to partner platforms (Booking.com, Skyscanner, Trainline, Rentalcars.com, GetYourGuide). If the User makes a booking via these links, OdysseAI may receive a commission at no extra cost to the User. OdysseAI is not a party to the contracts concluded between the User and these partners, which have their own terms and policies.

9. Limitation of liability

The Service is provided "as is" and "as available". To the maximum extent permitted by law, OdysseAI shall not be liable for: • Losses or damages resulting from travel decisions made on the basis of AI-generated content. • Cancellations, delays, boarding refusals, visa or border issues. • Outages or failures of third-party providers (Firebase, Stripe, Google, affiliate partners). • Data loss resulting from non-compliant use or force majeure. In any event, OdysseAI's liability towards a paying User is capped at the total amounts actually paid by that User for their subscription over the 12 months preceding the event giving rise to the claim. This limitation does not apply in the event of gross or wilful misconduct, nor to mandatory consumer rights under French law.

10. Termination and account deletion

The User may delete their Account at any time from the account settings. Deletion results in the erasure of all their data within 30 days, in accordance with the GDPR (see Privacy Policy). Cancellation of paid subscriptions is described in the Terms of Sale. OdysseAI may suspend or terminate the User's Account in the event of breach of these Terms, without prejudice to any claim for damages.

11. Personal data

Processing of the User's personal data is described in the Privacy Policy, accessible from the footer of the Service. That policy forms an integral part of these Terms.

12. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, the User is invited to contact OdysseAI first at plan.odysseai@gmail.com to seek an amicable solution. Consumer mediation: in accordance with Article L612-1 of the French Consumer Code, the User acting as a consumer may use a consumer mediator free of charge in the event of a dispute not resolved amicably. OdysseAI undertakes to designate and publish the contact details of its consumer mediator in a future version of these Terms. In the meantime, the User may also use the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr. Failing amicable resolution, the French courts have jurisdiction. In accordance with the Brussels I bis Regulation, the consumer may choose to bring proceedings either before the courts of their domicile or before the courts of the editor's place of establishment.
